Title

Can I rent my shop to a person who sells bacon sandwiches?

Question

 

 

I own a property shop which I rented to an english lady who sell cakes coffee and sandwiches.  I realised recently after we signed the lease that she also sells bacon sandwiches for breakfast as well.  Does this affect my income?  id this permissible?

 

Is this permissible?  Should I try to terminate the lease

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykumwa-rahmatullāhiwa-barakātuh.

 

It will be permissible for you to continue your lease with this woman and the rentals accrued will be Halal. Her selling bacon will not affect your income.[1][2]

[2]وَإِذَا اسْتَأْجَرَ الذِّمِّيُّ مِنْ الْمُسْلِمِ بَيْتًا لِيَبِيعَ فِيهِ الْخَمْرَ لَمْ يَجُزْ؛ لِأَنَّهُ مَعْصِيَةٌ فَلَا يَنْعَقِدُ الْعَقْدُ عَلَيْهِ وَلَا أَجْرَ لَهُ عِنْدَهُمَا، وَعِنْدَ أَبِي حَنِيفَةَ - رَحِمَهُ اللَّهُ - يَجُوزُ وَالشَّافِعِيُّ - رَحِمَهُ اللَّهُ - يُجَوِّزُ هَذَا الْعَقْدَ؛ لِأَنَّ الْعَقْدَ يَرِدُ عَلَى مَنْفَعَةِ الْبَيْتِ وَلَا يَتَعَيَّنُ عَلَيْهِ بَيْعُ الْخَمْرِ فِيهِ فَلَهُ أَنْ يَبِيعَ فِيهِ شَيْئًا آخَرَ يَجُوزُ الْعَقْدُ لِهَذَا، وَلَكِنَّا نَقُولُ تَصْرِيحُهُمَا بِالْمَقْصُودِ لَا يَجُوزُ اعْتِبَارُ مَعْنًى آخَرَ فِيهِ، وَمَا صَرَّحَا بِهِ مَعْصِيَةٌ،
