Title

Zakaat on money not in my possession

Question

I intend performing hajj this year inshallah. I take out a lump sum amount of money, as zakaat every ramadhaan. I have already paid my agent in full for the hajj trip. Do I still have to take out zakaat on this money which is not in my possession (the money has already been paid to the hajj operator)?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

The money you have paid to the travel agent for your hajj is an advance payment. You no longer have ownership of this wealth hence the money will not be zakaatable.[1]

[1] ومنها الملك التام وهو ما اجتمع فيه الملك واليد وأما إذا وجد الملك دون اليد كالصداق قبل القبض أو وجد اليد دون الملك كملك المكاتب والمديون لا تجب فيه الزكاة كذا في السراج الوهاج وأما المبيع قبل القبض فقيل لا يكون نصابا والصحيح أنه يكون نصابا كذا في محيط السرخسي. (وسببه) أي سبب وجوبها (الملك التام) بأن لا يكون يدا فقط كما في مال المكاتب، فإنه ملك المولى حقيقة وقد تقرر في كتب الأصول أن سبب وجوبها الملك المذكور وإن عده في الكنز شرطا لوجوبها (لنصاب) اعتبر النصاب لأنه - صلى الله عليه وسلم - قدر السبب به (فارغ عن الدين) المراد به دين له مطالب من جهة العباد حتى لا يمنع دين النذر والكفارة ويمنع دين الزكاة حال بقاء النصاب وكذا بعد الاستهلاك؛ (درر الحكام شرح غرر الأحكام، ج1ص172، دار الفكر)
