Title

1. Would it be permissible for a muslimah daughter to accept a wasiyyah of a non muslim mother? 2. How many Sajda Tilawa does a qari need to make if he listens the ayah many times? 3. What is the satr of a muslim woman from non muslims men or women?

Question

1. I understand that a muslim daughter may not inherit from her non muslim mother, but what if her mother made wasiyyat? would it be permissible to accept this wasiyyah?

2. If a Quran teacher listening to his students surahs, hears the same or different aayahs of sajdah over and over again whilst moving around the classroom, is one sajdah waajib for each individual ayah prayed,or will one sajdah suffice? please explain in detail, jazakallah.

3. What is the satr of a muslim woman/man in front of non muslim men/women?

Answer

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu `alaykum wa-rahmatullāhi wa-barakātuh.

1.) Yes, a  non-Muslim can make a wasiyyah (bequest) for a Muslim relative and similarly a Muslim can make wasiyyah (bequest) for a non-Muslim relative. This is as long as the bequest does not exceed 1/3 (one-third) of the net estate after paying for the funeral expenses and any debts owned by the deceased. When Muslims are inheriting from Muslims, a wasiyyah (bequest) for an inheritor is invalid as he is already receiving his assigned share.[i]

2.) There will be only one sajdah due for each verse of sajdah heard by the teacher per student, regardless of how many times the teacher hears it per student.[ii]

3.) The awrah of a Muslim female in front of a non-Muslim female is like the awrah of a Muslim female in front of a non-mahram male meaning that only the face, hands and feet be exposed in front of non-Muslim females. In addition a Muslim female should cover her face in front of any non-mahram male, Muslim or non-Muslim.

The awrah of a Muslim male in front of another male or female, Muslim or non-Muslim is from the navel to the knees, excluding the former (navel) and including the latter (knees). [iii] [iv]

[iii]ويجوز أن ينظر الرجل إلى الرجل إلا إلى عورته كذا في المحيط وعليه الإجماع ، كذا في الاختيار شرح المختار .
وعورته ما بين سرته حتى تجاوز ركبته ، كذا في الذخيرة وما دون السرة إلى منبت الشعر عورة في ظاهر الرواية
نظر المرأة إلى الرجل الأجنبي كنظر الرجل إلى الرجل تنظر إلى جميع جسده إلا ما بين سرته حتى يجاوز ركبته...
ولا ينبغي للمرأة الصالحة أن تنظر إليها المرأة الفاجرة ؛ لأنها تصفها عند الرجال فلا تضع جلبابها ، ولا خمارها...
عندها ، ولا يحل أيضا لامرأة مؤمنة أن تكشف عورتها عند أمة مشركة أو كتابية

[iv]( وتمنع ) المرأة الشابة ( من كشف الوجه بين رجال ) لا لأنه عورة بل ( لخوف الفتنة )
