Question

can a girl and boy make nikah on phone without a mulvi?and without 2 witnesess? my friend asked me this question that one night he was talking on phone with his girl friend and he did aajaab o qaabool with his girl friend now i will tell u exect wording so u can get better idea kia tum mere sath nikah karna chahu gi aur girl ne kaha yes phir larky ne kaha falan s/o falan 5000 haq maher k sath kia apko qabool hai teen bar pocha aur girl ne kaha qabool hai teen bar phir girl ne larke se pocha kia apko falan d/o falan qabool hai aur larke ne kaha qabool hai teen bar phir larke ne kaha k hamare is nikah ka witness Allah Miyaan hai

In the name of Allah, Most Gracious, Most Merciful


Assalaamu `alaykum waRahmatullahi Wabarakatuh

 

A nikāh by telephone is invalid.  The presence of at least two witnesses is a condition for the validity of a nikāh.  Therefore, your friend’s nikāh was not valid as there were no witnesses.

 

Islām forbids casual relationships between non-mahram males and females.  You should encourage your friend to stop all such harām relations and pursue the marriage through a halāl channel, such as through one’s family or the local imām.

 

قال عامة العلماء إن الشهادة شرط جواز النكاح

وقد روي عن رسول الله صلى الله عليه وسلم أنه نهى عن نكاح السر والنهي عن السر يكون أمرا بالاعلان لأن النهي عن الشيء أمر بضده وروي عنه صلى الله عليه وسلم أنه قال أعلنوا النكاح ولو بالدف ولنا ما روي عن رسول الله صلى الله عليه وسلم أنه قال لا نكاح إلا بشهود وروي لا نكاح إلا بشاهدين

قال: بلغنا عن رسول الله صلى الله عليه وسلم أنه قال: "لا نكاح إلا بشهود" وبه أخذ علماؤنا رحمهم الله تعالى

قوله (وشرط حضور شاهدين) أي يشهدان على العقد
