What is the opinion of the respectful Ulamas’s of the Ummat about the following two types of the lotteries. ...

Question

By the name of Allah who is the most compassionate and merciful.

 

What is the opinion of the respectful Ulamas’s of the Ummat about the following two types of the lotteries.

1. A person should collect at lest $100 in the bank, after drawing lots, he will lose the money whether he wins or not.

 2. A person should collect at lest $100 in the bank, but his money is save and doesn't discount in both cases of lose and win.

 

 Do these two matters are legal or illegal in Islam and what about the bonus of these kinds of lotteries?

 

Please respond to the above mentioned questions as soon as possible.

Answer

In the name of Allah, Most Gracious, Most Merciful


Assalaamu `alaykum waRahmatullahi Wabarakatuh

 

Answer in English:

 

1.      This first transaction falls under the explicit definition of qimār (gambling). Thus, it will not be permissible to enter into such a transaction.

2.      This second example, although it does not fall under the tenets of qimār it is still impermissible. The reason for that is by depositing $100 in the bank, in reality a person is giving the bank a loan for that amount. In an attempt to increase the amount of loans, the bank offers the lenders a chance to win money from the bank in exchange of extending loans to the bank. Standing a chance to win the lottery is a benefit, which comes directly in lieu of giving the loan. Therefore, such a transaction would fall under the ambit of the following principle, “Every loan that derives a benefit is Ribā.”

كُلَّ قَرْضٍ جَرَّ مَنْفَعَةً فَهُوَ رِبًا

 

Answer in Farsi:

 

1.     معامله أول زير تعريف قمار شامل می باشد  به همين دليل اين نوع معامله جائز نيست

2.     معامله دوم  اگر چه زير تعريف قمار شامل نه مى باشد باز هم جائز نيست براى اينكه 100$  به حساب بانك گذاشتن در حقيقت به بانك يك قرض است . در كوشش تكثير قرضان  بانك يك شانس به بردن پيسه پيش مى كنند و اين شانس يك نوع منفعة است كه در عوض قرض دادن است . اين معاملة زير قاعدة "هر قرض كه منفعة حاصل مى كنيد  او سود است" شامل مى باشد .

 

" كُلَّ قَرْضٍ جَرَّ مَنْفَعَةً فَهُوَ رِبًا "
