Title

Q1) What is the ruling on touching TRANSLATION ONLY (no Arabic) Qur'aan without Wudhu? ...Q2) What is the ruling on touching Tafseer& books of Fiqh etc. without Wudhu where the Arabic Qur'aan content is significantly less than the other (Tafseer, Fiqh) content?...Q3) What is the ruling on touching books of Hadeeth & Fiqh without Wudhu?

Question

I have searched your site and have been unable to find answers to this, please point me to a link where you have already answered these and I am Sorry for the trouble.

Q1) What is the ruling on touching TRANSLATION ONLY (no Arabic) Qur'aan without Wudhu? 

Q2) What is the ruling on touching Tafseer&  books of Fiqh etc. without Wudhu where the Arabic Qur'aan content is significantly less than the other (Tafseer, Fiqh) content?

Q3) What is the ruling on touching books of Hadeeth & Fiqh without Wudhu?

Answer

In the name of Allah, Most Gracious, Most Merciful

Assalaamu `alaykum waRahmatullahi Wabarakatoh

1) It is not permissible to touch translation only Quran without wudhu.

كذا الوضوء فرض ( لمس القرآن ولو آية ) مكتوبة على درهم أو حائط لقوله تعالى: {لا يمسه إلا المطهرون} وسواء الكتابة والبياض ، وقال بعض مشائخنا: إنما يكره للمحدث مس الموضع المكتوب دون الحواشي لأنه لم يمس القرآن حقيقة والصحيح إن مسها كمس المكتوب ، ولو بالفارسية يحرم مسه اتفاقا على الصحيح ( مراقي الفلاح: ص 82 دار الكتب العلمية )

وفي الفتاوى الهندية: ولو كان القرآن مكتوبا بالفارسية يكره لهم مسه عند أبي حنيفة وكذا عندهما على الصحيح هكذا في الخلاصة ( الفتاوى الهندية: 1 ص 39 دار صادر )

2) If the words of the Quran are more than that of the tafseer then it will not be permissible to touch the tafseer book without wudhu; otherwise it will be permissible as long as one does not touch the words of the Quran.

3) One may touch books of Hadith and Fiqh without wudhu; however, it is mustahab (preferable) to do wudhu before touching such books.

(و) القسم ( الثالث ) وضوء ( مندوب ) في أحوال كثيرة كمس الكتب الشرعية ، ورخص مسها للمحدث إلا التفسير ( مراقي الفلاح: ص 83 دار الكتب العلمية )

وقال في حاشية الطحطاوي: قوله ( كمس الكتب الشرعية ) نحو الفقه ، والحديث ، والعقائد ، فيتطهر لها تعظيما ( حاشية الطحطاوي على مراقي الفلاح: ص 83 دار الكتب العلمية )
