Title

Is it permissible to smoke hukkah? Is Hukkah makrooh or haraam?

Question

I will Cincearly appreciate it if you could furnish me with the Shar'i ruling ragarding the following:
 
1. Is it permissible to smoke hukkah? Is Hukkah makrooh or haraam?
 
2. I read in a pemphelet that if a chicken is slaughtered and then put into boiling water straight after that, while it has its insides, that chicken is Haraam. Is this correct?
 
3. Is there a Hadeeth Something to this effect that "This world is a prison for a mu'min and jannat for a kaafir" if there is such a hadeeth i will cincearly appreciate it if you can furnish me with the Arabic Text.

Answer

In the name of Allah, Most Gracious, Most Merciful

Assalaamu `alaykum waRahmatullahi Wabarakatoh

1.      It is makrooh to smoke hukka as it is detrimental to one’s health.

2.      If after slaughtering a chicken it is put in boiling water and left for such a time that the impurity could penetrate the meat then such a chicken will be haram.

( قوله : وكذا دجاجة إلخ ) قال في الفتح : إنها لا تطهر أبدا لكن على قول أبي يوسف تطهر ، والعلة - والله أعلم - تشربها النجاسة بواسطة الغليان ، وعليه اشتهر أن اللحم السميط بمصر نجس ، لكن العلة المذكورة لا تثبت ما لم يمكث اللحم بعد الغليان زمانا يقع في مثله التشرب والدخول في باطن اللحم ، وكل منهما غير محقق في السميط حيث لا يصل إلى حد الغليان ، ولا يترك فيه إلا مقدار ما تصل الحرارة إلى ظاهر الجلد لتنحل مسام الصوف ، بل لو ترك يمنع انقلاع الشعر ؛ فالأولى في السميط أن يطهر بالغسل ثلاثا فإنهم لا يتحرسون فيه عن النجس ، وقد قال شرف الأئمة بهذا في الدجاجة والكرش والسميط ا هـ وأقره في البحر .

3.    Imam Suyuti رحمه الله تعالى in his al-Jami al-Sagheer mentions this Hadeeth with reference to Musnad of Imam Ahmad, Muslim, Tirmidhi, Ibn Maja, Tabrani (Kabeer) and Hakim. He was classified this Hadeeth as Saheeh. The Arabic is:

 

حدثنا قتيبة بن سعيد حدثنا عبد العزيز - يعنى الدراوردى - عن العلاء عن أبيه عن أبى هريرة قال قال رسول الله -صلى الله عليه وسلم- « الدنيا سجن المؤمن وجنة الكافر ».صحيح مسلم
