Title

What would be the period of Iddat for a women who took Khula after 4 years of seperation from her husband in her 7 years of married life.

Question

 

What would be the period of Iddat for a women who took Khula after 4 years of seperation from her husband in her 7 years of married life.

Within these 7 years she lived 3 years with her husban and 4 years with her parents, as her husband and in-laws were causing mental harassment to her and a case was going on in the family civil court for 2 years.

She has a child and the husband after Khula, has clearly rejected to give maintenance for her and for the child.

Please do provide daleel "IF POSSIBLE" for the period of iddat in this case.

Note: Please explain the below statement mentioned in Islamic Sharia Council's website

Q.What is Iddat?        

Ans: In a case of Khul'a where the husband has conceded to Khul'a the Iddat period of a woman is for her to wait until her first monthly cycle is over.

Answer

In the name of Allah, Most Gracious, Most Merciful

 Assalaamu `alaykum waRahmatullahi Wabarakatoh

If the husband accepted the khula, then that will constitute one talaq-bain and the iddat will commence immediately after the khula is concluded. The iddat is three menstrual cycles if she experiences menses. If she does not experience menses, the iddat will be three months.

  1.بَابُ الْعِدَّةِ ( وَإِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ طَلَاقًا بَائِنًا أَوْ رَجْعِيًّا أَوْ وَقَعَتْ الْفُرْقَةُ بَيْنَهُمَا بِغَيْرِ طَلَاقٍ وَهِيَ حُرَّةٌ مِمَّنْ تَحِيضُ فَعِدَّتُهَا ثَلَاثَةُ أَقْرَاءٍ ) لِقَوْلِهِ تَعَالَى { وَالْمُطَلَّقَاتُ يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ ثَلَاثَةَ قُرُوءٍ } وَالْفُرْقَةُ إذَا كَانَتْ بِغَيْرِ طَلَاقٍ فَهِيَ فِي مَعْنَى الطَّلَاقِ لِأَنَّ الْعِدَّةَ وَجَبَتْ لِلتَّعَرُّفِ عَنْ بَرَاءَةِ الرَّحِمِ فِي الْفُرْقَةِ الطَّارِئَةِ عَلَى النِّكَاحِ ، وَهَذَا يَتَحَقَّقُ فِيهَا .

 

2.لَمَّا تَرَتَّبَتْ الْعِدَّةُ فِي الْوُجُودِ عَلَى فُرْقَةِ النِّكَاحِ شَرْعًا أَوْرَدَهَا عَقِيبَ وُجُوهِ الْفُرْقَةِ مِنْ الطَّلَاقِ وَالْإِيلَاءِ و َالْخُلْعِ .

3.قَوْلُهُ إذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ طَلَاقًا بَائِنًا أَوْ رَجْعِيًّا ) وَلَيْسَ رَجْعِيًّا فِي بَعْضِ النُّسَخِ وَشَمَلَ طَلَاقَ الْخُلْعِ وَاللِّعَانِ خِلَافًا لِمَنْ قَالَ : عِدَّةُ الْمُخْتَلِعَةِ حَيْضَةٌ وَاحِدَةٌ .قِيلَ : هُوَ بِنَاءٌ عَلَى أَنَّهَا فَسْخٌ .وَالْحَقُّ أَنَّهُ ابْتِدَاءٌ لِمَا تَقَدَّمَ فِي بَابِ الْخُلْعِ مِنْ الْمَنْقُولِ ، إذْ لَا يُعْقَلُ كَوْنُ الْفَسْخِ مُؤَثِّرًا فِي نُقْصَانِ الْعِدَّةِ وَلِذَا وَجَبَتْ ثَلَاثَةُ أَقْرَاءٍ فِي الْفَسْخِ بِخِيَارِ الْبُلُوغِ وَغَيْرِهِ ،
