Title

A relative in my family has died and in her will she has left me some money. The money has been in a term deposit interest earning account whilst she was alive

Question

A relative in my family has died and in her will she has left me some money. The money has been in a term deposit interest earning account whilst she was alive (she is not Muslim). My question is that is this money haram money to me because it was earning interest before it became mine? We don't know what the original amount invested was otherwise I'd just take that. Apparently she's had this account for years.

Answer

In the name of Allah, Most Gracious, Most Merciful  

Assalaamu `alaykum waRahmatullahi Wabarakatuh  

It is permissible to accept the entire amount bequeathed in your favour by your non-muslim relative. However, since the amount includes interest it is advisable to give it away in charity to the poor and needy. (Al-Fatawaa al-Hindiyya, vol 5, pg 349, Rasheediyya / Radd Al-Muhtaar, vol 5, pg 99, HM Saeed)

 

ويجوز ان يوصي المسلم للكافر و الكافر للمسلم (الهداية4\641)

 وفي منية المفتي: مات رجل ويعلم الوارث أن أباه كان يكسب من حيث لا يحل ولكن لا يعلم الطالب

بعينه ليرد عليه حل له الارث، والافضل أن يتورع ويتصدق بنية خصماء أبيه ا ه، وكذا لا يحل إذا علم عين الغصب مثلا وإن لم يعلم مالكه لما في البزازية: أخذ مورثه رشوة أو ظلما، إذا علم ذلك بعينه لا يحل له أخذه، وإلا فله أخذه حكما، أما في الديانة فيتصدق به بنية إرضاء الخصماء ا ه.

والحاصل: أنه إن علم أرباب الاموال وجب رده عليهم، وإلا فإن علم عين الحرام لا يحل له ويتصدق به بنية صاحبه وإن كان مالا مختلطا مجتمعا من الحرام ولا يعلم أربابه ولا شيئا منه بعينه حل له حكما، والاحسن ديانة التنزه عنه ( رد المحتار 5\99)

 وإذا مات الرجل وكسبه خبيث فالأولى لورثته أن يردوا المال إلى أربابه فإن لم يعرفوا أربابه تصدقوا به وإن كان كسبه من حيث لا يحل وابنه يعلم ذلك ومات الأب ولا يعلم الابن ذلك بعينه فهو حلال له في الشرع والورع أن يتصدق به بنية خصماء أبيه كذا في الينابيع (الفتاوي الهندية    5\349)
