Title

If praying witr behind a shafai imam, when should a hanafi read his qunoot as shafai imam reads his qunoot after rising from ruku

Question

Respecte MuftiSahab:

If praying witr behind a shafai imam, when should a hanafi read his qunoot as shafai imam reads his qunoot after rising from ruku and in hanafi one has to read his qunoot before going to ruku. Will witr be valid if qunot is not read before ruku.

Answer

In the name of Allah, Most Gracious, Most Merciful

Assalaamu `alaykum waRahmatullahi Wabarakatoh

It is permissible to follow a Shaf’ee Imam in witr prayers on the condition that he does not make salam after the second rakah.  The Hanafi followers will say their qunoot when the Shaf’ee Imam says it; i.e after the ruku’.

If the Imam makes salam after the second rakah and then performs the third rakah separately, the witr of the hanafi followers will not be valid.

Al-Durr al-Mukhtar ma’ Rad al-Muhtar (2:7) Dar al-Fikr

Al-Fatawa al-Hindiya (1:111) Maktaba Rasheediya

- (وصح الاقتداء فيه) ففي غيره أولى إن لم يتحقق منه ما يفسدها في الأصح كما بسطه في البحر (بشافعي) مثلا (لم يفصله بسلام) لا إن فصله (على الأصح) فيهما للاتحاد وإن اختلف الاعتقاد (و) لذا (ينوب الوتر لا الوتر الواجب كما في العيدين) للاختلاف (ويأتي المأموم بقنوت الوتر) ولو بشافعي يقنت بعد الركوع لأنه مجتهد فيه (الدر المختار)

- ولو صلى الوتر بمن يقنت في الوتر بعد الركوع في القومة والمقتدي لا يرى ذلك تابعه فيه . هكذا في فتاوى قاضي خان (الفتاوى الهندية)
