Title

Is there any time left for returning of her to her husband. If not then is TALAK has occured and what is iddat and when it will begin and how much is duration?

Question

My aunt has recieved notices of Talak from her husband through court. Now she has recieved the third notice, is there any time left for returning of her to her husband. If not then is TALAK has occured and what is iddat and when it will begin and how much is duration? kindly reply.

Answer

In the name of Allah, Most Gracious, Most Merciful

Assalaamu `alaykum waRahmatullahi Wabarakatoh

1.         Once the third talaak is issued, the nikah is completely broken. There is no time left for her to return to her husband.

 

2.         The iddat will begin immediately after Talaaq is given.

 

3.         If the woman whose husband divorced her experiences menstruation, then her iddat will be three menstrual cycles.

 

( وإذا طلق الرجل امرأته طلاقا بائنا أو رجعيا أو وقعت الفرقة بينهما بغير طلاق وهي حرة ممن تحيض فعدتها ثلاثة أقراء ) لقوله تعالى { والمطلقات يتربصن بأنفسهن ثلاثة قروء }

 

(Fathul Qadeer 4:136)

 

If the woman does not experience menstruation then her iddat is three months if she has not conceived. If she has conceived, then her Iddat will be till childbirth.

 

 ( وإن كانت لا تحيض من صغر أو كبر فعدتها ثلاثة أشهر ) لقوله تعالى { واللائي يئسن من المحيض من نسائكم } الآية ( وكذا التي بلغت بالسن ولم تحض )
